Welcome to eZfan. By accessing or using our platform, mobile application, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to all of these Terms, you must not use the Service.
You must be at least 18 years old to create an account or use the Service. By using eZfan, you represent and warrant that you are 18 or older, that you have the legal capacity to enter into a binding agreement, and that your use of the Service does not violate any applicable law or regulation in your jurisdiction.
We may require age verification at any time. Accounts found to belong to minors will be permanently terminated and any funds may be forfeited.
To access adult or erotic content, users must complete our age-gate flow by declaring a valid date of birth. Guest verification may be stored in a signed browser cookie for up to 30 days; authenticated verification may be stored on your account. Providing false age information is a material breach of these Terms and may result in immediate suspension or termination.
To access most features of eZfan, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. You are solely responsible for:
eZfan will not be liable for any loss arising from unauthorized use of your account. You may not share, sell, or transfer your account to any other person.
Creators who wish to monetize content must complete our identity verification process, which may include submitting a government-issued ID and proof of age documentation. This process is required to comply with applicable regulations and to protect all parties on the platform.
Creators are independent contractors, not employees, agents, or partners of eZfan. eZfan provides tools and infrastructure; creators are solely responsible for the content they publish, the taxes they owe on their earnings, and their compliance with applicable law.
You agree that you will not use the Service to:
You retain ownership of all content you create and upload to eZfan ("Your Content"). By submitting Your Content to the Service, you grant eZfan a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute Your Content solely for the purpose of operating and improving the Service.
You represent and warrant that you own or have the necessary licenses and permissions to post Your Content, and that Your Content does not infringe the intellectual property rights or privacy rights of any third party.
eZfan reserves the right to remove any content that violates these Terms or our Community Guidelines, at our sole discretion and without prior notice.
eZfan provides creators with tools to monetize their content through subscriptions, per-minute video/voice calls, tips, and other features. The current revenue split is 80% to the Creator / 20% to eZfan. This split may change, and any changes will be communicated with at least 30 days' notice.
Payouts are processed according to our current payment schedule. eZfan reserves the right to:
All payments made by fans to creators are final and non-refundable except as required by applicable consumer protection laws or as determined by eZfan in its sole discretion.
Fan subscriptions to creator accounts are billed on a recurring basis (monthly or as otherwise specified). Subscriptions auto-renew at the end of each billing period. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the then-current billing period; no partial refunds are issued.
The Service may integrate with or link to third-party services, including payment processors, calendar providers, and video infrastructure. Your use of those services is governed by their respective terms and privacy policies. eZfan is not responsible for the practices or content of any third-party service.
The eZfan name, logo, platform design, and all associated technology are the exclusive property of eZfan Ltd. and are protected by applicable intellectual property laws. You may not use our trademarks, service marks, or trade dress without our prior written permission.
We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, our Community Guidelines, or is harmful to other users, eZfan, third parties, or the public. You may also delete your account at any time through account settings.
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect, including but not limited to ownership, indemnity, disclaimers, and limitations of liability.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. eZfan does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not endorse any creator content or verify the accuracy of information posted by users.
To the maximum extent permitted by applicable law, eZfan and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of revenue, loss of data, or loss of goodwill — arising from your use of or inability to use the Service, even if eZfan has been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amounts you paid to eZfan in the 12 months preceding the claim, or (b) USD $100.
You agree to indemnify, defend, and hold harmless eZfan and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the London Court of International Arbitration (LCIA). You waive any right to a jury trial or class action.
We may modify these Terms at any time. If changes are material, we will provide at least 30 days' notice via email or in-app notification before the new Terms take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
Creators who publish adult or erotic material must accurately label both (a) their profile-level adult creator status and (b) each individual adult post. Mislabeling content or attempting to evade age restrictions is prohibited and may result in content removal, payout holds, suspension, or termination.
Unverified users may see blurred previews of adult-designated content, but access is restricted until age verification is completed. eZfan may require additional verification, including identity checks, where necessary for legal compliance, fraud prevention, or trust and safety.
Misusing adult labels to manipulate search ranking, discovery, or monetization is a violation of these Terms.
